Delegated legislation

The search process for delegated legislation, subsidiary legislation, legislative instruments and regulations can be found the same way as other legislation. However, you may need to filter your search results to the type of delegate legislation you are looking for.

You can access the legal databases via our databases page:

  1. Type the main words of the subsidiary legislation/delegated legislation/legislative instrument/regulation in the search box. Do not include the words Act or Regulations.
  2. The results list will include Acts, Regulations, etc. that have these words in the title
  3. Results can be filtered by:
    • Jurisdiction (e.g., Western Australia)
    • Type (e.g., Acts)
  4. Clicking on the title takes you to the authorised version of the Act.

Option 1 - Search by Legislative Instrument name

  1. On the Federal Register of Legislation search screen, select "In force" from the status bar
  2. In the "Search for" box, type the legislative instrument's name, or words within the name
  3. From the "Search in" drop down menu, select "Name"
  4. From the "Search using" drop down menu, select "Contains all the words"
  5. Below the search box, from the "Filter by Collection" menu, check "Legislative Instrument"
  6. Click "Search"
  7. Select the relevant legislative instrument from the results list

Option 2 - From the Act's homepage

  1. Navigate to an Act's homepage, then select the "Authorises" link from the activity menu
  2. Select a relevant legislative instrument from the results list
  3. Select from the activity menu to find out more about the legislative instrument:
    • Select "Details" for the legislative history
    • Select "Downloads" to access the explanatory statement.
  1. Find the home page for the relevant Act on the Western Australian Legislation website.
  2. Select "Subsidiary legislation made under this Act (current versions)". You will be taken to a page listing all in force and ceased subsidiary legislation under the Act
  3. Click on the title of the piece of subsidiary legislation that you wish to view.

If searching for regulations, continue with the following steps:

  1. Under "Subsidiary legislation" in the left hand side menu, select "As made"
  2. Select the relevant title or year of the Regulation (given in the citation or Act title)
  3. Navigate to regulation title or number
  4. Click on the "Page" icon (located on the far right in the table).
