A person who is not admitted to the legal profession is not entitled to use the words 'lawyer' or 'solicitor' in their title.
Section 14(1) of the Act, read together with items 1, 2, 5, and 6 in the Table to regulation 5(2) of the Legal Profession Regulations 2009, specifically restricts the use of those titles to persons admitted to the legal profession, or Australian-registered foreign lawyers, or Australian legal practitioners (being a lawyers who hold a practising certificate).
This includes the titles 'graduate lawyer' and 'graduate solicitor', as using the title of 'lawyer' or 'solicitor' in any variation may be a contravention of section 13(1) of the LPA, in that it might amount to a presumption that the person is representing an entitlement to engage in legal practice.
